Katie and Alex - A Foreign Marriage - Sarah Dalton
The recent Las Vegas marriage of Katie Price and Alex Reid raises the question of whether their marriage is valid under English Law as it took place outside of England and Wales.
If a couple choose to celebrate their marriage abroad they must ensure they comply with both the formal requirements of the country where they choose to marry, together with the formal requirements of the country which was their permanent home prior to their marriage. Therefore, in the case of Katie and Alex this would be England and Wales.
It should also be noted, however, that the English Courts may still recognise a marriage that does not comply with English Law as long as both parties to a marriage permanently reside outside of England and Wales. This will only occur, however, if the formalities of both this country and the country where they choose to marry are still complied with, otherwise the marriage will be void.
Katie Price and Alex Reid would also have to ensure that they have the capacity to marry under English Law. Should they not have had the appropriate capacity to marry, for example one of them was already married, then their marriage would not be valid under English Law. Their marriage would be void and treated as though it had never existed.
