Clinical Negligence
If you have suffered clinical negligence at the hands of medical experts resulting in physical or psychological damage, it is vitally important to know who to turn to so that the situation will be handled effectively on your behalf.
When clinical negligence occurs, even the most routine treatment can result in time off work, upheaval within the family or even disability or fatality.
Our clinical negligence department is able to advise and represent clients in claims relating to negligent events, not only in medical and surgical situations but also in other areas of associated practice such as nursing, dentistry, chiropody and optometrics. We are pleased to offer a service covering the whole spectrum of clinical negligence cases from the most complex multi-million pound cases to straightforward claim of negligence.
Our dedicated team of highly specialised lawyers and clinical professionals provide a sympathetic and friendly service, using their considerable range of experience and expertise to obtain the best results for you. Our success in achieving this is reflected by the number of referrals which we receive from existing clients.
We have members of both the Action against Medical Accidents (AvMA), and the Solicitors Regulation Authority Clinical Negligence Panel, indicative of the high standards and strength of our team.
We have a Legal Services Commission franchise and are able to offer a number of different methods of funding your claim including Legal Aid, conditional fee agreements (no win no fee) and acting under legal expenses insurance.
Professional Deputy & Court of Protection
We are able to deal with professional deputyship matters where an individual is unable to manage their own financial affairs due to mental incapacity in close liaison with our Court of Protection department. This can be particularly relevant in clinical negligence cases where an award of damages is made but unfortunately the Claimant is unable to personally manage their financial dealings. This service can relieve the family of what can sometimes be a difficult situation.
If a professional deputy is to be appointed following a clinical negligence case, the likely cost can be included within the claim. For more information about this service, please see our dedicated Court of Protection page.
Discretionary Trusts
We are also able to advise upon the potential benefits of placing any award of damages (or part of it) into a trust. This could achieve the potential benefit of maintaining eligibility for means tested benefits.
We are pleased to be able to offer advice in relation to the benefits of a potential trust, setting up a trust and acting as professional trustees if required. For more information about this service, please see our Wills, Trusts and Estates pages.
Legal Aid Franchise
Lees Solicitors are pleased to confirm that we hold Legal Aid franchises for Clinical Negligence.
This means that, where applicable, we are able to advise and represent clients under the Legal Aid scheme in Clinical Negligence Matters.
If you have suffered avoidable harm, injury or loss as a result of substandard treatment, the emotional and physical effects can be severe. We can apply our professional and personal service to investigate, advise and pursue a claim on your behalf. Sometimes the alleged negligence has caused the patient to die, in which case a claim could be made by their family in some circumstances.
Location is not an issue; our services are available to clients nationwide.
