Alternative Dispute Resolution

Alternative Dispute Resolution (ADR) is rapidly gaining favour with Courts as a sensible alternative to legal proceedings in appropriate cases. Parties to disputes for which Court Proceedings have been started are actively encouraged by the Courts to consider ADR as a way of settling a case before it comes to trial.

There are two main types of ADR.

Mediation is an informal means of Alternative Dispute Resolution and broadly involves both sides to the dispute putting their views forward through a qualified mediator. A Mediator acts as a facilitator to allow both sides to air their grievances and focus upon the issues with a view to settlement. Mediators are not authorised to impose a settlement on the parties but will encourage the parties to resolve their dispute with the aim of avoiding litigation.

Arbitration is a more formal type of ADR. An Arbitrator is empowered by the terms of appointment to make an award to determine the dispute.

The main advantages with any form of ADR or arbitration are a potential saving in time and costs and the procedures are conducted in private compared to Court Proceedings which are in the public domain.
