Case summary - Settlement of £3,299.81 for client injured whilst operating a pneumatic drill - Elen Wynne Roberts

In 2006 our client was working at a building site where he was employed to lay gas piping. In order to do this he had to dig up the ground in preparation to lay the pipes.

His employers only put two men on the site and the job turned out to require more men than this. Our client requested another team member to help on site so that they could share the drilling but was refused on three occasions, despite health and safety regulations stating otherwise.

During the course of the drilling it became apparent that the drill given to our client was not suitable for the job. Again despite numerous requests for a suitable drill, he was refused. Subsequently whilst carrying on his work with the inadequate tools and without the required number of men on the job he suffered injuries to his chest.

As a result of the injury to his chest our client was signed off work for 7 weeks and required care and assistance during his time off. Liability was eventually admitted by the Defendant. His claim for general damages settled in the sum of £1,500.00 and he was rewarded £1,799.81 for financial losses (e.g. loss of earnings), giving a total settlement figure of £3,299.81.
