clinical negligence solicitors

Clinical negligence occurs when a patient is harmed as a result of a doctor or other healthcare professional failing to meet the standards expected of them.

Lees Solicitors have successfully acted on behalf of thousands of patients who have fallen victim to clinical negligence, from GP and A&E errors to cosmetic surgery claims. We understand what you’re going through, enabling us to offer practical and personal support.

our clinical negligence team

Our experienced team consists of nine solicitors, six paralegals, two former doctors, one nurse and an ex-midwife.

We also understand that, for certain problems (e.g. gynaecology negligence claims), you may find it easier to speak to someone of the same sex. Lees can offer male and female solicitors who will handle your case with care and sensitivity.

We will also help you consider other ways to deal with your clinical negligence claim, such as the NHS Complaints Procedure or, in fatal cases, a Coroner’s Inquest.

At Lees Solicitors, we do our best to fit around your lives, visiting you at home and out of hours if needed. Our team are members of specialist panels that reflect our expertise.

Our team also has close links with specialist local charities, helping us to understand the everyday issues you are facing.

time limits on claims

In most cases, clinical negligence claims are only eligible for compensation for three years after the date of an accident or negligent act.

If you are not immediately aware of the issue, arguments may be put forward that this reverts to three years from the date you learned the extent of your condition, the identity of the defendant and the nature of the medical negligence.

This may depend on the facts of each case, so it is always best to look into any possible clinical negligence claim with the help of a solicitor as soon as possible, so that deadlines are not missed.

In cases involving children, their three-year time limit usually starts from the date of their 18th birthday. There are also different rules for those who lack mental capacity.

Do you think it is a good case?

It is hard to assess the merits of a case fully before we have seen the relevant medical records and, if necessary, seen the reports from independent experts.  Our usual procedure is to consider the facts given to us by the client and then decide whether we are able to take the enquiry any further.  We would then review it again once the medical records and any other documents or reports are to hand, and indeed, will keep the merits of the case under review throughout the case.

How long will it take?

Investigation of a case usually takes between 18m-2yrs, although more complex cases can take longer. Much depends on how quickly the hospitals etc provide the medical records and then on what the waiting list of the experts are like, and whether you need to be seen by more than 1 expert.

What did you think of Lees Solicitors?

I was kept constantly up to date as soon as information from the Defendant was received,  (rather than have to 'chase' and constantly ring up for news).Fiona Kempand her team treated me as a person and not just another client and it was always with courtesy, respect and friendliness. I wouldn't hesitate to recommend Lees.

What did you think of Lees Solicitors?

You have been extremely kind and helpful and I've been very happy with the service that I have received all along.  Someone was always available to answer my calls, and if they could not answer my call they would get back to me the same day
