Visiting an accident and emergency clinic is usually a traumatic time for any patient, as it means your injuries or illness requires urgent attention.

The trauma is much worse if your doctor fails to treat you correctly, and injuries or diseases can become worse too.

how a&e claims work

A&E doctors have to deal with a wide variety of cases, ranging from emergency patients who arrive dramatically in an ambulance to those who have been referred by their GP. There is no such thing as an ‘average’ clinical negligence case against A&E staff.

1)      Missed diagnosis – We have acted for a number of clients whose true diagnosis was incompetently missed by an A&E doctor. The consequences of such mistakes can be serious, for example if an illness turns out to be a life-threatening condition such as cancer or meningitis.

2)      Poor treatment – Sometimes a claim hinges on the decisions taken by a medical professional during your treatment, for example when the type or dosage of a drug is wrong.

3)      Failure to treat – Where a diagnosis was made but the patient was not provided with the necessary treatment.

Do you think it is a good case?

It is hard to assess the merits of a case fully before we have seen the relevant medical records and, if necessary, seen the reports from independent experts.  Our usual procedure is to consider the facts given to us by the client and then decide whether we are able to take the enquiry any further.  We would then review it again once the medical records and any other documents or reports are to hand, and indeed, will keep the merits of the case under review throughout the case.

How long will it take?

Investigation of a case usually takes between 18m-2yrs, although more complex cases can take longer. Much depends on how quickly the hospitals etc provide the medical records and then on what the waiting list of the experts are like, and whether you need to be seen by more than 1 expert.
