Going through a separation is a tough time for any couple, and this is always magnified whenever children are involved.

Generally, the Court will only make an order in relation to children when it is in the best interests of the child.

If all parties agree, the Court will not interfere with their arrangements regarding child support where the child will live or who the child will spend time with if it is satisfied that everything is agreed and workable.

However, if parents do not agree, they can negotiate via their solicitors, attend mediation or speak to a collaborative lawyer. If no agreement can be reached, they will need to seek a Court order.

what orders can the court make?

When making its judgement, the child’s interests will be the Court’s primary concern ahead of the wishes of the parents. In these circumstances, it can make the following orders:

  1. Child Arrangements Order – Stating with whom the child should live and with whom they should spend time with. Child Arrangements Orders can also include provision for indirect contact such as letters and telephone calls.  This replaces the old Residence and Contact Orders.
  2. Specific Issue Order – Deals with a specific aspect of a child’s upbringing, e.g. name changes.
  3. Prohibited Steps Order – Allows one parent to stop the other doing something in relation to the child.
  4. Parental Responsibility Order – Provides parental responsibility in respect of a child.
