lasting powers of attorney

A Lasting Power of Attorney is an important document that ensures your best interests are looked after should you lose the mental and/or physical capacity to manage your own affairs.

If you do not have one, those caring for you may be required to make a costly and time consuming application to the Court of Protection.

A Lasting Power of Attorney must be registered at the Office of the Public Guardian before it can be used. Our specialist team can help with this and many other aspects of granting lasting powers of attorney.

There are two types of Lasting Powers of Attorney. You can choose to have just one in place, or both:

property and financial affairs

This grants your attorney the authority to deal with your property, including its management or selling. Your attorney will be able to control your finances, which will include paying your bills and managing your bank accounts, investments, shares and pensions as required.

health and welfare

Your attorney can become a key figure if you lose the mental capacity to make your own medical decisions. For example, they will oversee medical treatment you receive, as well as welfare issues such as your care home.

Their authority can even extend to giving or refusing consent for life-sustaining medical treatment.

choosing your attorney

Your attorney is someone you choose to act on your behalf should you be incapable of doing so. They can be a family member, friend or professional; your most important consideration should be finding someone you trust who has the necessary skills to carry out the role.

You must be absolutely certain that whoever you choose will always act in your best interests and work in accordance with your wishes.
